1. Acceptance of these Terms

These Terms of Service form an agreement between you and Penguin Game Design. By accessing this website or downloading, installing or using Fractured Cosmos, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the relevant service.

2. Fractured Cosmos

Fractured Cosmos is provided for private, non-commercial entertainment. The game is distributed through an app store and is intended to function primarily offline.

The absence of online accounts or leaderboards means that Penguin Game Design cannot recover, synchronise or transfer player progress between devices.

3. Limited licence

Subject to these Terms, Penguin Game Design grants you a personal, limited, revocable, non-exclusive, non-transferable and non-sublicensable licence to install and use Fractured Cosmos on compatible devices that you own or control, solely for private, non-commercial use.

You do not acquire ownership of the game, website, software, artwork, content or underlying intellectual property.

4. Acceptable use

You must not, except where applicable law expressly permits it:

• copy, sell, rent, redistribute or commercially exploit the game or website;
• reverse engineer, decompile, disassemble or attempt to derive source code;
• remove or alter copyright, trademark or ownership notices;
• use modified software, malicious code or tools intended to interfere with the game, advertisements or app-store services;
• misrepresent yourself as Penguin Game Design or an authorised representative; or
• use the game or website in a way that violates applicable law or infringes another person's rights.

5. Local save data

Game progress and settings are stored locally on your device. Penguin Game Design does not provide cloud backup, account recovery or cross-device synchronisation.

You are responsible for maintaining your device and any backups supported by the device or app-store platform. Uninstalling the game, clearing app data, resetting or losing the device, or installing an incompatible update may result in permanent loss of progress.

6. Advertising

Fractured Cosmos may be supported by non-personalised advertisements supplied through Unity Ads, a service provided by Unity Technologies. Non-personalised advertisements are not selected from a profile of your past behaviour, but Unity may still process limited technical information for ad delivery, frequency control, aggregated reporting, consent management, security and fraud prevention.

Advertising availability, frequency, format and rewards may change. We do not guarantee that a particular advertisement or rewarded-ad opportunity will always be available. Unity Ads is subject to Unity's own terms and privacy policies. More information is provided in our Privacy Policy.

7. App stores and third-party platforms

The game may be downloaded through Google Play or another authorised app store. The store's own terms, licence rules, privacy policy, device requirements and refund procedures also apply.

Penguin Game Design is not responsible for outages, account restrictions, payment processing or other independent actions of an app-store operator or advertising provider.

8. Development, updates and availability

We may modify, balance, update, suspend or discontinue parts of the game. This may include units, factions, missions, progression, rewards, advertisements, compatibility and technical requirements.

We do not promise that every pre-release screenshot, description or announced feature will appear unchanged in the final game. Updates may be required for continued compatibility, and older versions may stop functioning correctly. Mandatory consumer rights remain unaffected.

9. Intellectual property

The game, website and their original content are owned by or licensed to Penguin Game Design. This includes the Fractured Cosmos name and universe, faction names, characters, unit designs, artwork, user-interface designs, text, graphics, logos, audio, animations, software, source code, game systems and documentation.

Nothing in these Terms transfers our intellectual-property rights to you. Third-party trademarks, platforms and content remain the property of their respective owners.

10. Feedback and submissions

You may voluntarily send bug reports, suggestions or other feedback. You retain ownership of rights you already have in your submission, but you grant Penguin Game Design a worldwide, perpetual, irrevocable, royalty-free and transferable licence to use, reproduce, adapt and incorporate that feedback into our products and communications without payment or an obligation to use it.

Do not send confidential material or content that you do not have the right to share.

11. Disclaimers

To the extent permitted by law, the game and website are provided on an “as available” basis. We do not guarantee uninterrupted availability, error-free operation, compatibility with every device, preservation of local save data or immediate correction of every defect.

Nothing in these Terms removes warranties or remedies that cannot legally be excluded, including mandatory consumer protections.

12. Limitation of liability

To the maximum extent permitted by applicable law, Penguin Game Design is not liable for indirect or consequential losses that were not reasonably foreseeable, or for losses caused by events outside our reasonable control.

Nothing in these Terms excludes or limits liability where doing so would be unlawful. Mandatory statutory rights remain unaffected.

13. Governing law and disputes

These Terms are governed by the laws of the Netherlands. Before starting formal proceedings, you and Penguin Game Design should first try to resolve the dispute by contacting each other.

If you are a consumer, this choice of law does not deprive you of mandatory protections or jurisdiction rights available under the law of your country of residence.

14. Changes to these Terms

We may update these Terms to reflect changes to the game, website, advertising model, app-store requirements, technology or law. The revised page will show a new update date and version number.
